Terms of Service and Cancellation Policy
Terms of Service and Cancellation Policy are important statements that direct and regulate the use of any given Internet site.
For Daytrips (Diving Daytrips, Snorkeling, Tours):
1. 1 In the event whereby the Company on its own voluntary basis, cancels a trip or a course, the Company will be responsible to refund the customer all amounts paid to the Company by the customer; the Company will not accept any responsibilities to finance any changes or cancellations of any itineraries due to reasons beyond the Company’s control such as those specified above.
1. 2 If the owed service of the Company means it has to take the boat backup to the land due to evacuation of a certain customer, the Company shall not be held liable for any alteration to the itinerary.
1. 3 It is the amount per-head paid by the customer to support his/her booking. The deposit is non-refundable where a cancellation is made less than 72hrs to the scheduled time the trip/or course is due to start ( 7:00am).
1. 4 The outstanding balance should be settled to the Company, prior to the time the trip or course is supposed to start. The outstanding amount will be non-refundable where a cancellation is produced less than 72 hours to the agreed time the trip is to commence or the customer fails to turn up on the agreed date.
1. 5 Where cancellation is done after 72 hours or more to the time when the trip is supposed to happen, the deposit paid is returned and the Company can return the balance if paid already. The refund payment will be done with deduction of (200 THB + 10% of refundable amount) for the Credit Card Processor fees.
1. 6 If the customers decided not dive due to ear problems, seasickness, or any other reasons that are not in any way associated with the company, the money will not be refunded.
For Liveaboards:
1. 1 Where the Company itself has cancelled a trip or course, without any of the aforementioned reasons the Company will return all monies paid by the customer; the Company will not accept any liability for itineraries that it has changed or cancelled due to a factor beyond the Company’s reasonable control such as those mentioned above.
1. 2 If, for example, the client needs to be evacuated from the boat and the boat has to go back to the shore, the Company can not take any financial responsibility for the changes that will occur to the rest of the itinerary.
1. 3 If the customer cancels an order, the amount paid as the deposit is non-refundable in case the cancellation is done when the liveaboard is due to depart between 3 P.M. and 7 P.M The conditions for cancellation are as follows:
1. 4 The balance should be paid in cash to the Company before the date on which the travel or the course is planned to begin. This amount will prove non-reclaimable in the event of cancellation within 30 days to the time the trip is due to commence or where the client fails to show up for the trip.
1. 5 In the event the cancellation is done 30 or more days to the time when the trip is anticipated to commence, the client is entitled to a refund of the deposit amount and the Company may effect the balance if paid. Out of the refund payment, the consumer shall be provided with a refund payment of: -10% Bank transfer fees.
1. 6 Hence, should the customers not dive due to reasons such as; ear problems, seasickness, or any other conditions not related to the working of the company, the customer will not be eligible for a refund.
1. 7 If customers fail to do the dives for any reason there will be no refund.
1. 8 If there is any change in the schedule or the dive site or any other related activities to do with weather condition and other factors beyond the company’s control there will be no refund.
Please be advised clients who booked Khao Lak Explorer, will be bound by the terms of service and the cancellation policy.
